Terms of Use
Last updated 20 October 2026
This version adds sections 12 to 16 on billing and renewals, the 30-day money-back guarantee, cancellations, refunds and uptime. Please read the terms below before you order.
These Terms of Service (the "Agreement") are an agreement between lurstanhost.com, LLC ("Lurstan Host", "us", "our", or the “Company”) and you ("User" or "you" or "your"). This Agreement sets forth the general terms and conditions of your use of the products and services made available by Lurstan Host and of the lurstanhost.com website (collectively, the "Services"). By using the Services, you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Services.
1. Additional Policies and Agreements
-
Use of the Services is also governed by the following policies, which are incorporated by reference. By using the Services, you also agree to the terms of the following policies.
- Additional terms may also apply to certain Services, and are incorporated by reference herein as applicable. For example, if you register a domain name with us, then the Domain Registration Agreement will also apply to you and would be incorporated herein.
2. Account Eligibility
-
By registering for or using the Services, you represent and warrant that:
- You are eighteen (18) years of age or older. The Services are intended solely for Users who are eighteen (18) years of age or older. Any registration, use of or access to the Services, by anyone under eighteen (18) is unauthorized and is a violation of this Agreement.
- If you use the Services on behalf of another party you agree that you are authorized to bind such other party to this Agreement and to act on such other party's behalf with respect to any actions you take in connection with the Services.
- It is your responsibility to provide accurate, current, and complete information on the registration forms, including an email address that is different from the domain you are signing up under. If there is ever an abuse issue or we need to contact you, we will use the primary email address we have on file. It is your responsibility to ensure that the contact information for your account, including any domain accounts is accurate, correct and complete at all times. Lurstan Host is not responsible for any lapse in the Services, including without limitation, any lapsed domain registrations due to outdated contact information being associated with the domain. If you need to verify or change your contact information, you may utilize the Lurstan Host Billing and Support Portal to update your contact information. Providing false contact information of any kind may result in the termination of your account. In dedicated server purchases or certain other cases, you may be required to provide government issued identification and possibly a scan of the credit card used for verification purposes. Failure to provide the information requested may result in your order being denied.
- You agree to be fully responsible for all use of your account and for any actions that take place through your account. It is your responsibility to maintain the confidentiality of your password and other information related to the security of your account.
- Any dedicated IP order in addition to those provided with a hosting package may be subject to IP justification. IP justification practices are subject to change to remain in compliance with the policies of the American Registry for Internet Numbers (ARIN). We reserve the right to deny any dedicated IP request based on insufficient justification or current IP utilization.
- The Service and any data you provide to Lurstan Host is hosted in the United States (U.S.) unless otherwise provided. If you access the Service from outside of the U.S., you are voluntarily transferring information (potentially including personally-identifiable information) and content to the U.S. and you agreeing that our collection, use, storage and sharing of your information and content is subject to the laws of the U.S., and not necessarily of the jurisdiction in which you are located.
3. Transfers
Our Transfers Team will make every effort to help you move your website to us. Transfers are provided as a courtesy service. We do not make any guarantees regarding the availability, possibility, or time required to complete an account transfer. Each hosting company is configured differently, and some hosting platforms save data in an incompatible or proprietary format, which may make it extremely difficult, if not impossible, to migrate some or all account data. In some cases we may not be able to assist you in a transfer of data from an old host. The free transfer service is available for thirty (30) days from your sign up date. Transfers outside of the thirty (30) day period will incur a charge; please contact a member of our Transfers department to receive a price quote. In no event shall Lurstan Host be held liable for any lost or missing data or files resulting from a transfer to or from Lurstan Host. You are solely responsible for backing up your data in all circumstances.
4. Lurstan Host Content
- Except for User Content (as defined below), all content made available through the Services, including images made available through website builder tools provided by Lurstan Host (the “Licensed Images”), designs, templates, text, graphics, images, video, information, software, audio and other files, and their selection and arrangement, and all software used to provide the Services (collectively with the Licensed Images, "Lurstan Host Content"), are the property of Lurstan Host or its licensors. No Lurstan Host Content may not be modified, copied, distributed, framed, reproduced, republished, downloaded, scraped, displayed, posted, transmitted, sold or exploited for any purpose in any form or by any means, in whole or in part, other than as expressly permitted in this Agreement. You may not, directly or indirectly, reverse engineer, decompile, disassemble, or otherwise attempt to derive source code or other trade secrets from any Lurstan Host Content.
- To the extent applicable, you are granted a limited, revocable, non-sublicensable, license to use the Licensed Images solely in connection with the Services. You are prohibited from using any Licensed Images: (i) with pornographic, defamatory, or unlawful content or in such a manner that infringes upon any third party's trademark or intellectual property rights; (ii) as a trademark, service mark, or logo; and (iii) portraying any person depicted therein (a "Model") in a way that a reasonable person would find offensive, including but not limited to depicting a Model: (a) in connection with pornography, "adult videos", adult entertainment venues, escort services, dating services, or the like; (b) in connection with the advertisement or promotion of tobacco products; (c) as endorsing a political party, candidate, elected official, or opinion; (d) as suffering from, or medicating for, a physical or mental ailment; or (e) engaging in immoral or criminal activities.
- Any use of Lurstan Host Content, other than as specifically authorized herein, is prohibited and will automatically terminate your rights to use the Services and any Lurstan Host Content. All rights to use Lurstan Host Content that are not expressly granted in this Agreement are reserved by Lurstan Host and Lurstan Host's licensors.
5. User Content
- You may be able to upload, store, publish, display and distribute information, text, photos, videos, emails, and other content on or through the Services (collectively, "User Content"). User Content includes any content posted by you or by users of any of your websites hosted through the Services ("User Websites"). You are solely responsible for any and all User Content and any transactions or other activities conducted on or through User Websites. By posting or distributing User Content on or through the Services, you represent and warrant to Lurstan Host that (i) you have all the necessary rights to post or distribute such User Content, and (ii) your posting or distribution of such User Content does not infringe or violate the rights of any third party.
Solely for purposes of providing the Services, you hereby grant to Lurstan Host a non-exclusive, royalty-free, worldwide right and license to: (i) use, reproduce, publicly perform, publicly display, modify, translate, excerpt (in whole or in part), publish and distribute User Content; and (ii) make archival or back-up copies of User Content and User Websites. Except for the rights expressly granted herein, Lurstan Host does not acquire any right, title or interest in or to the User Content, all of which shall remain solely with you.
- Lurstan Host exercises no control over, and accepts no responsibility for, User Content or the content of any information passing through Lurstan Host's computers, network hubs and points of presence or the Internet. Lurstan Host does not monitor User Content. However, you acknowledge and agree that Lurstan Host may, but is not obligated to, immediately take any corrective action in Lurstan Host's sole discretion, including without limitation removal of all or a portion of the User Content or User Websites, and suspend or terminate any and all Services without refund if you violate the terms of this Agreement. You hereby agree that Lurstan Host shall have no liability due to any corrective action that Lurstan Host may take.
6. Compliance with Applicable Law
- You agree to comply with all applicable laws, rules, and regulations, including without limitation all local rules where you reside or your organization is location regarding User Content, User Websites, online activities, email and your use of the Services. More specifically, but without limitation, you agree to comply with all applicable laws regarding the transmission of technical data exported to or from the United States or the country in which you reside. The Services are controlled and operated by us from our offices within the United States (although we may share data with third parties around the world to assist us in providing the Services as further described in our Privacy Notice) and we make no representation that the Services are appropriate or available for use in other locations. Those who access the Services from other locations do so at their own initiative and risk, and are fully responsible for compliance with all applicable laws in those locations. We do not offer the Services where prohibited by law.
For the purposes of European Directive 95/46/EC, the General Data Protection Regulation 2016/679) (“GDPR”) and any applicable national implementing laws in your jurisdiction, and with respect to your subscribers’ or customers’ personal data, you acknowledge and agree that you are the Controller (as that term is defined in the GDPR), and we are a Processor (as that term is defined in the GDPR) insofar as you may store personal data through your use of our Services only as permitted and subject to the terms of this Agreement. You also acknowledge and agree that you are responsible for complying with all obligations of a data controller under applicable law (including the GDPR).
To the extent the GDPR applies to you, you represent and warrant that in using our Services, you will clearly describe in writing how you plan to use any personal data collected and you will ensure you have a legitimate legal basis to transfer such personal data to us and that you have the necessary permission to allow us to receive and process (e.g., store) such personal data on your behalf. The additional data processing terms set forth here shall apply where you are a Controller subject to the GDPR.
12. Billing and Renewals
This section explains how you pay for the Services and how they renew. Every price is shown in our store at my.lurstanhost.com before you pay.
- Prices and currency. You pay the price shown in the store when you order, in the currency shown on your invoice: naira, US dollars, pounds sterling or euros. Prices exclude VAT, which is not charged while our turnover is under the small-company threshold.
- Paying. Pay each invoice with one of the payment methods shown at checkout. We set up a Service once its first invoice is paid and any check it needs is complete, such as the approval of SMTP relay orders described in the Email Policy. A website bundle is paid in full before the build starts.
- Billing cycles. Each Service is billed in advance for the cycle you choose, such as monthly or yearly. Care plans are billed monthly. Domains are billed for one or more years at a time.
- Renewals. A Service or domain renews for the same cycle when you pay its renewal invoice. We email each renewal invoice to the address on your account before the due date, and it is also in the client area. For domains we send reminders 30, 14, 7 and 1 days before expiry. Keep your contact details current on the account details page, as section 2 requires. To stop a renewal, cancel the Service as section 14 describes.
- Price changes. We review prices every quarter and give thirty days' notice before we change the price of a Service you already have. Domain prices follow our registrar's rate, so a renewal may cost more or less than the first year; the renewal invoice shows the price before you pay. A promotional price applies only for the period the promotion states.
- Website bundles and care plans. A website bundle is a one-off price. It includes the first three months of hosting, email, SSL and daily backups. From the fourth month a care plan takes over and is billed monthly: the Care Plan after the Business Bundle or Business Bundle Plus (₦15,000 a month at the date of these terms), and Shop Care after the Online Shop (₦45,000 a month at the date of these terms). Day one of a build is the working day we have both your payment and your content. If a site is not live within the working days set for its bundle (seven for the Business Bundle, ten for the Business Bundle Plus, 21 for the Online Shop), your fourth month of care is free: one month of the Care Plan, or of Shop Care after the Online Shop.
- Unpaid invoices. If an invoice is not paid by its due date, we may suspend the Service until it is paid. If it stays unpaid, we may terminate the Service, and its data is then deleted as section 14 describes. A domain that is not renewed by its expiry date may stop working and can be lost; restoring it, where the registry allows, can cost more than a renewal.
- Questions about an invoice. If you think an invoice is wrong, open a ticket at my.lurstanhost.com/submitticket.php and we will check it.
13. Money-Back Guarantee
If a new hosting or server plan is not right for you, you can cancel it within 30 days and have your money back. This section sets out what the guarantee covers and what it does not.
- What it covers. Web hosting (Starter, Business and Business Plus), WordPress hosting, Linux VPS on NVMe and USA RDP plans. Cancel within 30 days of your first payment for the plan and we refund what you paid for it, as section 15 describes.
- When it applies. The guarantee applies to the first order of a plan, not to renewals. It applies once for each customer and each kind of plan.
-
What it does not cover. The guarantee covers only the plans listed above. In particular it does not cover:
- domain registrations, renewals and transfers, which are paid to the registry and cannot be undone. If a domain came free with a yearly plan, the domain stays registered in your name and we deduct its normal price from the refund;
- SSL certificates;
- software licences sold as separate items or add-ons;
- other add-ons from third-party suppliers in our store, such as website backup, VPN and site builder;
- a website bundle once the build has started (it starts on day one, the working day we have both your payment and your content). Before that, we refund the bundle less the price of any domain already registered for it;
- care plans, which you can cancel any month as section 14 describes;
- SMTP relay plans, except that a refused relay order is refunded in full, as the Email Policy says;
- work already done for you, such as extra hours of changes, malware clean-up or a paid migration.
- Breaches. The guarantee does not apply to a Service suspended or terminated under section 5 or the Acceptable Use Policy (Enforcement).
- How to claim. Within the 30 days, open a ticket at my.lurstanhost.com/submitticket.php, or choose Request Cancellation on the Service in the client area, and say that you are claiming the money-back guarantee. We reply to confirm the amount.
14. Cancellations
You can cancel any Service at any time. This section explains how, and what happens to your website, email, domain and data.
- How to cancel. In the client area at my.lurstanhost.com, open the Service and choose Request Cancellation, or open a ticket at my.lurstanhost.com/submitticket.php. Say whether the Service should end at once or at the end of the period you have paid for. A cancelled Service does not renew. Refunds are covered in section 13 and section 15.
- Care plans. You can cancel a care plan any month; the site stays yours. The care plan ends at the end of the month you have paid for, and the hosting, email, SSL, backups and updates it pays for end with it. If you cancel during the three months included with your bundle, you pay nothing for the care plan, and those services run to the end of the third month. Ask us before the end date and we give you a full copy of your website files and database, so you can move the site to another host or keep it with us on a web hosting plan. The mailboxes close with the care plan, so copy any email you want to keep, or move the mailboxes to a hosting or business email plan first.
- Domains. Your domain is registered in your name and stays yours. Cancelling hosting or a care plan does not cancel the domain: it stays registered until its expiry date, and you can renew it with us or move it to another registrar. To move it, ask us in a ticket for its transfer code.
- VPS and RDP servers. When a server ends, the server and its disks are deleted. Copy your data off it before the end date.
- Your data after a Service ends. We keep the data of a Service only until the Service ends. It is then deleted, and it leaves our backups as they rotate, within 30 days, as the Privacy Notice says. We do not promise to restore anything after the end date.
- When we end a Service. We may suspend or end a Service for an unpaid invoice, as section 12 describes, or for a breach of this Agreement, including the Acceptable Use Policy. A Service that we stop offering is covered in section 15.
15. Refunds
This section explains when we refund and how.
-
When a refund is due. We refund:
- under the money-back guarantee in section 13;
- when we refuse an SMTP relay order, as the Email Policy says;
- when we cannot provide something you have paid for, such as a domain the registry refuses or a transfer that fails;
- when we stop offering a Service you have paid for, for a reason other than your breach of this Agreement: we refund the unused part of the period you paid for.
- When it is not. Outside those cases, cancelling a Service early, or not using it, does not give a refund for the rest of a period you have paid for. No refund is due for a Service suspended or terminated for an unpaid invoice or for a breach of this Agreement.
- How we refund. We refund in the currency of your invoice, to the payment method you used where that method accepts refunds. Where it does not, we pay into a bank account in the name of the account holder. If you prefer, we add the amount to your account as credit, which pays future invoices.
- How long it takes. We tell you in the ticket when the refund has been sent. How long it then takes to reach you depends on your bank or payment provider.
- Your legal rights. Nothing in sections 12 to 16 takes away a right you have under the Federal Competition and Consumer Protection Act 2018 or any other law that cannot be excluded by contract.
16. Uptime and Status Page
We do not promise an uptime percentage. Instead we check our main services every minute and publish the results on our public status page at lurstanhost.com/status.
-
What the status page checks. Every minute it opens each of these services the way a customer would:
- our website lurstanhost.com, the client area and billing at my.lurstanhost.com, and our outgoing company email;
- on the shared hosting server cloud.lurstanhost.net, which runs Starter, Business, Business Plus and WordPress hosting: the web server for customer websites (HTTPS), cPanel (port 2083), incoming email (IMAP, port 993) and outgoing email (SMTP, port 587);
- on the node in the USA that runs Linux VPS on NVMe and USA RDP servers: the node's network and the VPS and RDP control panel;
- our nameservers, ns1 and ns2.lurstanhost.com and ns1 and ns2.lurstanhost.net, each pair asked a real DNS question.
- How it counts. A service is marked down only after a second failed attempt. Each stretch of downtime is listed as an incident automatically, and the page shows the incidents of the last 30 days. Uptime on the page is the share of checks that answered over the last 90 days, or since a check began if that is more recent. The checks run from our own network, so they show whether a service answers, not how fast it is from your connection.
- What it does not check. It does not check each customer website, VPS or RDP server one by one, business email mailboxes (which run on the mailbox provider's platform), SMTP relay plans, or anything outside our network, such as domain registries and your own internet connection.
- When something is down. An outage is worked on within the hour, any day of the week. Everything else is answered within one working hour, Monday to Friday, 08:30 to 17:30 Lagos time. If a Service is down for you but the status page shows it as up, open a ticket at my.lurstanhost.com/submitticket.php.
- No service credits. We do not give automatic service credits for downtime. This section does not change your rights under section 15 or under the law.
21. Email Marketing
This section applies when you use the Services to send marketing email: newsletters, promotions and any other message sent to a list rather than to one person who wrote to you. It applies with our Email Policy, Dedicated Mail Policy and Acceptable Use Policy, which are part of this Agreement; where two rules differ, the stricter one applies.
- Consent. You may send marketing email only to people who have given confirmed (double) opt-in consent: they entered their address on your form and clicked a confirmation link sent to that address. Keep the date, time, source and IP address of each sign-up and confirmation and give us that record within two working days of our request. Do not send to bought, rented, scraped or appended lists, or to addresses collected for another purpose.
- Content. Every marketing message must identify you as the sender, carry accurate headers and an honest subject line, and show a postal address where the recipient's law requires one. It must include an unsubscribe link that works without a login, and List-Unsubscribe and List-Unsubscribe-Post headers so that one-click unsubscribe works. Honour an unsubscribe within two days and do not email that address again unless the person opts in afresh.
- Where to send it. You may send a newsletter or other marketing email to your confirmed opt-in list from a hosting account. The mailing must meet this section and fit inside the hourly limit shown for your plan in the Email Policy. A larger list, or regular campaigns, must go through an SMTP relay plan or a third-party mailing service; VPS and RDP servers may not be used for mass mailing.
- Law. You must comply with the marketing and data protection law where you and your recipients are. In Nigeria that is the Nigeria Data Protection Act 2023. It requires a lawful basis to use a person's email address (section 25) and affirmative, provable consent (section 26), and lets a person object to direct marketing at any time (section 36). The Cybercrimes (Prohibition, Prevention, etc.) Act 2015 as amended in 2024 defines spamming as indiscriminately sending unsolicited bulk messages. Abroad it may include CAN-SPAM (United States), the GDPR and ePrivacy rules (European Union), the UK GDPR and PECR (United Kingdom) and CASL (Canada). Our consent rule is stricter than some of these laws and applies regardless.
- Monitoring. On relay plans we measure bounce and complaint rates and act on them under the Email Policy. A serious or repeated breach may lead to suspension or termination of the affected Service without refund. You must compensate us for any claim, penalty or reasonable cost that arises from your breach of this section.
Email Policy
This policy covers every email sent through the Services, from hosting accounts, business email, SMTP relay plans and VPS or RDP servers. It is part of our Terms of Service and is read with section 21 (Email Marketing).
-
Rules for all mail. You must not use the Services to:
- send unsolicited bulk email, or email to a bought, rented, scraped or appended list;
- send phishing, malware, loan or cryptocurrency scams, advance-fee fraud or other deceptive messages, or pornographic content;
- forge or hide the origin of a message, use a From address you are not authorised to use, or impersonate anyone;
- rotate IP addresses, domains or accounts to evade filtering, rate limits, a pause or a blocklisting;
- send bulk mail without a working unsubscribe method, or keep sending to someone who has unsubscribed (mail to one person who wrote to you needs none).
- Consent. Marketing and bulk mail may be sent only under the consent, proof-of-consent and unsubscribe rules in section 21.
- Hosting and business email. Hosting mailboxes are for the ordinary correspondence of a website or business and for marketing to your confirmed opt-in list within the hourly limit, as section 21 allows. Only a small overflow above the limit, set on the server, is queued for a later hour; the rest is refused and not sent, so a larger mailing must not be sent from hosting. The server may also temporarily block a domain whose failed or deferred messages reach the percentage and count set on the server. Business email mailboxes run on the mailbox provider's platform and follow its limits and acceptable-use terms.
- Current limit. At the date of this policy: 200 messages an hour for each domain on every web hosting and WordPress hosting plan.
- Sending from hosting. Mail clients should use authenticated SMTP on port 587 (STARTTLS) or 465 (TLS). Scripts and content-management systems should send through an SMTP plugin authenticated to a mailbox on your account, from your own domain. When your DNS is with us, SPF and DKIM records are created automatically; otherwise publish them yourself. If a mailbox or script is found sending spam, usually because it was compromised, we suspend its outgoing mail, may change its password and notify you. Sending resumes once you confirm the infected files or scripts are removed.
- VPS and RDP servers. Outbound port 25 is closed by default and opened only on request after you explain the intended use; mass mailing from a server is not permitted even if port 25 is open. You administer your server and are responsible for every message it sends, even when compromised; we may close port 25 again or suspend the server on abuse reports.
-
SMTP relay plans. In addition to the rules above:
- orders are approved by hand after we see your sending domain, website, list source, expected volume and a sample email; a refused order is refunded in full;
- before the first send your domain must publish SPF, a 2048-bit DKIM key and a DMARC record aligned with your From domain;
- submission is on ports 587 (STARTTLS) and 465 (TLS), with 2525 as a fallback; port 25 is not offered;
- hard bounces, complaints and unsubscribes are suppressed automatically and must not be re-added;
- sending stops at the monthly volume of your plan and any hourly or daily caps shown for it unless you buy more volume;
- we do not promise inbox placement; receiving providers decide what they accept.
-
Thresholds. On SMTP relay plans we measure hard bounces, and complaints reported to us by receiving providers, as a share of messages from each sending domain over a rolling 24 hours:
- at 2 per cent hard bounces or 0.1 per cent complaints, after 1,000 messages in the period, we warn you to clean your list;
- at 5 per cent or 0.3 per cent, after 3,000 messages in the period, sending is paused automatically;
- a spam-trap hit, or a public blocklisting of your domain or your dedicated IP, pauses sending at once;
- a listing of a shared-pool IP is ours to handle: we may pause the pool while we find the cause, and a pause another customer caused does not count against you.
- After a pause. To resume, tell us the cause and what you have changed; we may ask for your list source and consent records first. We request delisting of our IP addresses and help you delist your domain. A second pause caused by your own sending within 90 days, a refusal to provide proof of consent, or a breach of the rules for all mail may lead to suspension or termination without refund.
- Enforcement and appeals. For an ongoing spam run, a compromised mailbox or server, a blocklisting or a spam-trap hit we act first and notify you afterwards. Otherwise the notice period and appeals in the Acceptable Use Policy (Enforcement) apply.
- Data protection. For your recipients' personal data you are the controller and we are a processor acting on your instructions, under section 6, the Nigeria Data Protection Act 2023 and any data processing terms we publish. Relay logs and delivery events are available to you for 30 days. Traffic data and subscriber information are kept for two years and released only as the Acceptable Use Policy describes.
- Reporting. Report spam or abuse from our network as the Acceptable Use Policy (Reporting violations) says. Questions about this policy go to support@lurstanhost.com.
Dedicated Mail Policy
This policy applies to SMTP relay plans that include a dedicated IP address and to dedicated-IP add-ons. It adds to the Email Policy and section 21 (Email Marketing), which still apply.
- Approval and assignment. A dedicated IP is assigned only after your relay order is approved by hand and your sending domain passes our SPF, DKIM and DMARC checks. Each IP is used by one customer at a time. You may not share, sublet or resell it, or route mail for a domain that is not on your plan or that you are not authorised to send for. The IP remains ours: you have exclusive use of it while the plan is active, paid for and not suspended, and no right to keep or transfer it. Dedicated IPs are also subject to the IP justification rules in section 2 and the policies of the registry that allocates them.
- Reverse DNS. We set the PTR (reverse DNS) record of each dedicated IP to a hostname on your sending domain; you must keep a matching A record pointing back at the IP. We do not start sending from the IP until both records resolve. Tell us before you change the hostname so we can update the PTR record.
- Warm-up. A new dedicated IP has no sending history, so it gets a managed 30-day warm-up. Daily volume starts low and rises on a schedule we set. Mail above the day's allowance is not sent from the IP that day; we tell you at approval whether it goes through the shared pool or waits. Do not send time-critical mail from the IP during warm-up. If bounces or complaints rise during warm-up we slow or extend the schedule. You cannot opt out of or shorten the warm-up; the sending caps of your plan apply only after it is complete.
- Reputation. A dedicated IP's reputation is built by your sending alone. The bounce and complaint thresholds in the Email Policy apply to mail sent from the IP. We monitor public blocklists; if your IP or domain is listed, sending is paused at once and we ask you for the cause and the fix. We then request delisting of the IP and help you delist your domain. We do not move you to a fresh IP to escape a listing, and do not promise that a dedicated IP will perform better than the shared pool.
- Additional IPs. You may request another dedicated IP after 30 days of clean sending, meaning no pause, listing or breach of the Email Policy. Beyond the IPs included in or added to your plan at order, we allocate at most one more IP for every 500,000 messages of monthly plan volume. Each additional IP is warmed up in turn, and the IPs on your plan may be used together as one pool for the same stream of mail. Splitting mail to hide a bad list or dilute complaints, or rotating IPs or domains to evade filtering or a listing, is forbidden and leads to the removal of every dedicated IP.
-
Withdrawal and replacement. We may withdraw or replace a dedicated IP where:
- it is listed on a blocklist through your sending and cannot be delisted;
- you breach this policy or the Email Policy;
- the plan or add-on is cancelled, lapses or is unpaid;
- our upstream provider requires a change; we give at least seven days' notice where we can.
- After withdrawal. No refund is due under the first two grounds. A returned IP is rested before reuse. Appeals follow the Acceptable Use Policy.
Acceptable Use Policy
This policy applies to every Service we provide, including resold products, and is part of our Terms of Service. Lurstan Host operates from Nigeria and these policies follow Nigerian law; servers may be in the United States or elsewhere, as section 2 says. You are responsible for everything done through your account, including by your staff and users, except where our own breach of this Agreement causes it. The Email Policy and Dedicated Mail Policy add stricter rules for email.
-
Prohibited uses. You may not store, publish, link to or send through the Services content that:
- is unlawful in Nigeria, where you are, or where the content is directed;
- is pornographic, or sexually exploits or endangers children, which leads to termination at once;
- promotes violence, terrorism or hatred, threatens, harasses or defames a person, or discloses private information without a lawful basis;
- defrauds, including phishing pages, advance-fee fraud, investment, loan or cryptocurrency scams, pyramid schemes and counterfeit goods;
- contains malware, spyware, ransomware, exploit kits or botnet controllers;
- infringes copyright, trade marks or other rights;
- sells medicines, firearms, gambling or other regulated goods or services without the required licence.
-
Prohibited conduct. You may not use the Services to:
- access any system or data without authorisation, or interfere with any service, including by denial-of-service attacks;
- send spam or breach the Email Policy, harvest email addresses, or advertise a site hosted with us by spam sent from anywhere;
- test or use stolen payment cards or credentials, or impersonate Lurstan Host or anyone else;
- run open mail relays, open proxies, open DNS resolvers or Tor exit nodes on any Service;
- run VPN or proxy services, IRC bots, torrent trackers or file sharing on shared hosting;
- mine cryptocurrency on shared hosting, or on a server beyond your plan's resources;
- open a new account to evade a suspension or unpaid balance, or resell the Services or give a third party control of your account, except under a reseller plan.
- Shared hosting resources. Your account may use up to the limits shown for your plan; unlimited means fair use that does not degrade the server for others. Hosting space is for your websites and their mail, not for backups of other systems, file sharing or scripts that run continuously. Keep software up to date and remove what you do not use; an account hacked through outdated software may be suspended until cleaned. If you regularly exceed your limits we ask you to reduce usage or upgrade; where overuse affects others we may throttle or suspend first.
- VPS and RDP servers. Servers are unmanaged: you administer the operating system and software and must keep them updated and secured. You are responsible for all traffic to and from the server, even if it is compromised, and for the licence terms of your software. Email from a server is governed by the Email Policy, which closes outbound port 25 by default. We may isolate or suspend a server that attacks others or draws abuse reports.
-
Copyright notices. We follow the notice-and-takedown procedure in Part VII of the Nigeria Copyright Act 2022. Our designated address for notices under that Part is abuse@lurstanhost.com. A notice must be in writing and contain what section 54 requires:
- your physical or electronic signature;
- identification of each work you say is infringed;
- identification of the infringing material and its location;
- your contact details;
- a declaration on oath, such as an affidavit, that you believe the use is not authorised by the owner, its agent or the law;
- a statement that the notice is accurate and that you are authorised to act for the owner.
- Incomplete, foreign and false notices. We return an incomplete notice and say what is missing. A United States DMCA notice, which has no declaration on oath, is handled under section 5 of this Agreement, not Part VII, and its sender is liable to us for a false statement. Knowingly misrepresenting that material is infringing, or was removed by mistake, makes you liable under section 57 for the damage our reliance causes.
- What we do with a notice. On a complete notice we promptly inform the customer responsible, remove or disable access to the material and notify the complainant, as section 55 requires. The customer may send a written counter-notice, which we forward to the complainant at once. If the complainant does not reply within seven days to show that the customer was not authorised, we may restore the material. We take effective steps, in line with high industry standards, to stop removed content being reloaded, and remove it promptly without notice. Either party may refer a dispute about a notice to the Nigerian Copyright Commission under section 55(4).
- Repeat infringers. After a first notice against an account we warn the customer in writing that a further notice will lead to suspension and ask them to confirm receipt. On a second notice, unless a challenge is pending, we suspend the account for at least one month, as section 56 requires. A customer may challenge a warning within ten days by a signed counter-notice giving their contact details and the facts they rely on. If it is not resolved within ten days we refer it to the Nigerian Copyright Commission.
- Other complaints. For defamation, privacy, trade mark and personal data complaints we remove content on a court order, a regulator's direction (for example the Nigeria Data Protection Commission) or where the breach is clear on its face. Otherwise we forward the complaint to the customer, who has five working days to respond.
-
Enforcement. We do not monitor content as a matter of course; we act on reports, automated abuse and resource alerts, and lawful requests:
- for most breaches we notify you, explain what must change and give you at least 48 hours to fix it;
- where there is an immediate risk to our network, other customers or the public, or the content is plainly unlawful, we may suspend at once and notify you afterwards;
- a serious or repeated breach, or a failure to fix one when asked, may lead to termination;
- no refund or money-back guarantee applies to a Service suspended or terminated under this policy;
- fees already invoiced remain payable, and you must reimburse our reasonable, documented costs of the breach, such as delisting work and third-party claims;
- you may appeal within seven days by replying to the ticket or opening one at my.lurstanhost.com; a person who did not take the original decision answers within three working days.
- Lawful requests. We keep traffic data and subscriber information for the two years that section 38 of the Cybercrimes (Prohibition, Prevention, etc.) Act 2015 as amended in 2024 provides for. We preserve or release it on a lawful request from a court, law enforcement or a regulator. We cooperate with the Nigeria Data Protection Commission, the Nigerian Copyright Commission and other authorities, including abroad, where the law allows. We report child sexual abuse material and credible threats to life on our own initiative.
- Reporting violations. Report abuse to abuse@lurstanhost.com with the URL, IP address or full email headers, the date and time with time zone, and what happened. We acknowledge reports within one working day.
